Overview

Tracey T. Barbaree represents businesses and individuals in all aspects of employment and civil rights litigation, including Rule 23 class actions and collective action claims under the Fair Labor Standards Act (FLSA). She also particularly enjoys litigating individual employment discrimination claims in a cost-effective, focused manner that regularly results in success. She represents individuals and employers in federal and state court litigation and before agencies and counsels employers on matters arising under federal and state laws such as:

  • The Fair Labor Standards Act (FLSA)
  • The Equal Pay Act (EPA)
  • Title VII of the Civil Rights Act
  • The Age Discrimination in Employment Act (ADEA)
  • The Americans with Disabilities Act (ADA)

Some highlights of her experience include:

  • Favorable trial verdicts in cases involving claims such as race discrimination, sexual harassment, and retaliation claims
  • Positive results regarding class certification of race and gender hiring, promotion, and training claims against national restaurant chain
  • Completion of all stages of major reductions-in-force – from planning through separation and release agreements – for a national employer
  • Favorable rulings on ADA, ADEA and the Family and Medical Leave Act (FMLA) claims, which were affirmed by the U.S. Court of Appeals for the Eleventh Circuit
  • Frequent representation of clients in arbitration, mediation, and other proceedings designed for early or prompt resolution of disputes

Tracey currently serves as an adjunct professor at Georgia State University Law School and speaks to professional groups on employment law issues. Prior to forming Moeller Barbaree, she was a partner at a national labor and employment law firm and a co-chair of the class action practice group. After law school, she was a judicial clerk for the Hon. Richard C. Freeman, U.S. District Court, Northern District of Georgia.
